What does the EU Charter of Fundamental Rights offer for labour law post-Lisbon ?

In this seminar, Jeffrey Kenner (Chair in European Law at the University of Notthingham) will explore the implications for labour law in Europe of the formal incorporation by reference of the Charter of Fundamental Rights of the EU (CFREU) into the EU Treaties now that the Treaty of Lisbon has entered into legal force.

It will first identify the extent to which individual and collective labour rights are featured in the CFREU in the context of the corpus of EU law and the laws of the Member States.

Further issues to be discussed will include the legal effectiveness of the CFREU, its relationship with the ECHR in the light of the EU's planned accession, and certain problems such as the Protocol concerning Poland and the United Kingdom. Selected cases will be discussed including Laval and Viking.

The final part will include an analysis of the extent to which, if at all, the CFREU post-Lisbon offers opportunities to strengthen the protection of individual and collective labour rights at a national and European level.
