12.45 pm Presentation by Prof. Dr. Alexander Proelß : "International Legal Obligations of EU Member States and European Union Law"

Following the decision of the European Court of Justice (ECJ) in the Intertanko case, the paper will take the measures included in the newly adopted third legislative package on maritime safety (“Erika III” package) of the European Union (EU) as the starting point for analysing whether at all and, in the affirmative, to what extent the role of the EU ought to be regarded as being generally limited in light of international legal requirements. It will critically assess the reasoning of the ECJ in the Intertanko case and other relevant proceedings. Based on this assessment, an alternative interpretation of the relationship between EU law on the one hand and relevant specifications of international law (including procedural requirements concerning dispute settlement contained in individual treaties) on the other will be submitted. It will be suggested that the approach followed by the Court concerning the role of the EU as an actor in international relations is too narrow both in terms of substance and standard of judicial review.

Prof. Dr. Alexander Proelß

Alexander Proelss studied law in Bonn and Tübingen and completed the first state examinations in Tübingen in 2000. In 2003, he obtained his doctoral degree with a thesis on the theme of “Protection of the Marine Environment in Public International Law and European Law”. In 2004, he completed the period of articling with the second state examinations. Thereafter, he was appointed Assistant Professor at the Faculty of Law in Tübingen and in November 2005 he was retained as a research associate at the Federal Constitutional Court.

Following his return to the Faculty of Law at the University of Tübingen, he accepted the offer of a professorship in public law, with particular focus on the law of the sea, at the Walter-Schücking Institute for International Law, Christian Albrechts University-Kiel, in July 2007. In February 2010, Alexander Proelss was awarded the postdoctoral qualification (Habilitation/venia legendi) by the Faculty of Law at the University of Tübingen.

Since 1 October 2010, he has been Professor of Public Law, in particular Public International Law and European Law, at the University of Trier. He is one of the directors of the Institute for Environmental and Technology Law and a member of the board of directors of the Centre for European Studies of the University of Trier. The international law of the sea as well as international environmental law, along with other questions in the area of public international law, European Law and constitutional law, constitute the focal points of his research.
