The New Architecture for the European Financial Supervision: from CESR to ESMA

La Faculté de Droit, d'Economie et de Finance de l'Université de Luxembourg invite Carlo Comporti, ancien secrétaire général de l'ESMA, à venir présenter, à l'occasion d'un séminaire de midi qui se tiendra le 25 avril 2012 de 12h30 à 13h45, la nouvelle architecture de la surveillance financière européenne.

Carlo Comporti

Carlo Comporti is Director at Promontory advising countries, institutions and clients on securities and financial markets, with a particular focus on the regulatory environment in the European Union and its business implications. He assists clients in addressing difficult regulatory and enforcement issues, as well as in implementing sound governance and business solutions.

Experience

With a background that combines regulatory and supervisory experience, Carlo worked for 13 years with the European Securities and Market Authority and its predecessors, most recently as Acting Secretary General of the Authority, which is the EU financial regulatory institution that focuses on securities and investor protection. He also served as Secretary General of the Committee of European Securities Regulators, an ESMA predecessor. He joined the Authority in 1998, when it was known as the Forum of European Securities Commissions, and was a member of the Secretariat specializing in investor protection and the Markets in Financial Instruments Directive (MiFID), a European Union law that provides consistent regulation for investment services across the member states of the European Economic Area. During his tenure with at the Authority, he was also stationed in 2001 and 2002 at the European Central Bank and the European Commission. Carlo began his career with the Italian Securities and Exchange Commission (Commissione Nazionale per le Società e la Borsa), working as an Officer in the intermediaries and international relations offices. He is also a certified accountant.

The recent establishment of the new European Supervisory Authorities (ESMA, EBA and EIOPA) has profoundly changed the EU regulatory and supervisory landscape in financial services. Whilst it is still too early to draw conclusions on the functioning of this new framework, it is important to understand the innovations of this new European System compared to the institutional framework of the so called “Lamfalussy procedure” and the role played by the then existing EU Committees of supervisors (CESR, CEBS and CEIOPS). Having contributed to the establishment of CESR and its recent transformation into ESMA, Carlo Comporti will highlight the main differences between ESMA and CESR and will describe the new operational and legal framework of the European System of Financial Supervision and, particularly, the establishment of the new Authorities.
