The proposed Common European Sales Law - A common law perspective

La Faculté de Droit, d'Economie et de Finance de l'Université de Luxembourg  invite Christian Twigg-Flesner, professeur de l'Université de Hull, à présenter, à l'occasion d'un séminaire de midi qui se tiendra le 20 mars 2012 de 12h15 à 13h45, la proposition de la Commission de droit commun européen de la vente du point de vue de la "common law".

Christian Twigg-Flesner

Professor Christian TWIGG-FLESNER is Professor of Commercial Law and Convenor of the Trade and Commercial Law Centre at the University of Hull in East Yorkshire, England, and an Academic Fellow of the Inner Temple. He read law at the University of Sheffield and was awarded his doctorate for research into the law on manufacturers’ guarantees by the same University. Before joining Hull in 2004, he worked at the University of Sheffield and Nottingham Trent University. He has written widely on consumer law and European Contract Law. His publications include The Europeanisation of Contract Law (Routledge, 2008) and he was co-editor of the EC Consumer Law Compendium (Sellier, 2008; with Hans Schulte-Nölke and Martin Ebers). His most recent book is A Cross-Border-Only Regulation for Consumer Transactions in the EU (Springer, 2012). He is co-editor (Law) for the Journal of Consumer Policy and a member of the Acquis Group. In addition to his scholarly work, he regularly assists the UK Law Commission and the Department for Business with question of consumer law reform.

12.30 pm Presentation  : The proposed Common European Sales Law - A common law perspective

The proposal for a Common European Sales Law (CESL) raises complex issues about its interaction with national law. CESL will cover areas of law on which there is already established national legislation (often EU inspired), but also introduce provisions with no obvious corresponding national equivalent. From a common law perspective, the idea of a general requirement of 'good faith and fair dealing' raises some concerns, unsurprisingly. This seminar will offer a Common Lawyer's perspective on CESL.
